CAGAYAN DE ORO CITY – The Law Department of the Commission on Elections (Comelec) has filed a Motion to Withdraw the Petition for Disqualification before the Comelec Second Division against Raineir Joaquin Velez Uy, incumbent punong barangay of Carmen here, and candidate for Representative of this city’s 1st legislative district in the 2025 elections.
In its motion dated December 17, 2024, the Comelec Law Department emphasized the need for prudence and due diligence in reassessing the evidence and circumstances surrounding the case.
It underscored that in the interest of justice and fairness, the poll body’s law department found it appropriate to withdraw the petition for disqualification against Uy.
This information was relayed by lawyer Al An E. Geñoso of Carrasco and Geñoso Law Office, counsel for Uy.
In a statement provided to the media Wednesday afternoon, Dec. 18, Uy welcomed the motion to withdraw filed by Comelec’s law department.
He further expressed gratitude to his supporters and reiterated his firm resolve to continue serving the people of Cagayan de Oro.
“The COMELEC Law Department’s decision to withdraw the petition highlights the significance of fairness and due process in our democracy. From the very start, we called for the facts and evidence to prevail. We will remain focused on delivering meaningful service and moving forward together for the progress of Cagayan de Oro,” Uy said in the statement.
Reporters were able to obtain a copy of the motion to withdraw the petition for disqualification dated Dec. 17, 2024, which was signed by at least three Comelec law department officials, namely, Maria Norina Tangaro Casingal, Albert Leonard Rodriguez, and Persis del Camat-Dabalos.
In the motion, the signatories said “recent information pertinent to the case” was what prompted them to withdraw their petition.
“Recent information pertinent to the case was received by Petitioner and requires the re-assessment of the documents and evidence presented, as well as the further investigation of the matter, if so warranted,” they said.
“Moreover, Petitioner, by reason of prudence and due diligence opts to evaluate the Petition filed and the case in its entirety to properly and faithfully discharge the Honorable Commissioner’s mandate to enforce and administer laws relative to the conduct of elections for the purpose of ensuring free, orderly and honest elections,” the Comelec law department officials said.
“Considering that the foregoing which may alter the course of the instant case, and in the interest of justice and fairness, Petitioner hereby moves for the withdrawal of the Petition,” they added.
“WHEREFORE, premises considered, it is most respectfully prayed of this Honorable Commission that the instant Motion to Withdraw Petition for Disqualification against Respondent RAINEIR JOAQUIN VELEZ UY be GRANTED,” the petitioners said. (Jigger Jerusalem | MT)
