The Supreme Court on Thursday evening corrected a claim made by Senator Risa Hontiveros regarding the “League of Cities” case, saying the decision was not unanimous as she had suggested.
Hontiveros brought up the case during Senate discussions on whether to archive the impeachment complaint against Vice President Sara Duterte, which the SC earlier invalidated in a 13-0 vote. She cited it as an example of the Court reversing itself in unanimous decisions.
However, SC spokesperson Camille Ting clarified in a media statement: “We clarify that the Supreme Court’s ruling in the League of Cities case was not unanimous. Please refer to the Decision and Resolutions published in the Supreme Court E-Library and the Philippine Reports.”
Ting further noted that the Court was “uncertain as to the source of the claim that the decision was unanimous.”
In her remarks, Hontiveros also mentioned another case—International Service for the Acquisition of Agri-Biotech Applications, Inc., et al. v. Greenpeace Southeast Asia—to bolster the position of Senate Minority Leader Tito Sotto, who had urged the chamber to wait for the SC’s final ruling on a pending motion for reconsideration in the Duterte case.
